MOM Work Pass not required for Exempt Activities

From 1 February 2008 Foreigners will also have the flexibility to enter Singapore and perform certain activities for short durations without a Work Pass. Foreigners who are exempted from Work Pass requirements would include those performing activities currently exempted under the PVP scheme and two new activities. These new activities are exempted because they require specialised skills or expertise that is generally not available in Singapore. They are sporadic in nature and carried out for only a short period and the foreigners performing these activities do not have an employer-employee relationship with the local company. They are:

i) Those providing expertise or specialised skills :

a) In the commissioning or audit of any new plant or equipment (including any audit to ensure regulatory compliance or compliance with one or more standards); or

b) In the installation, dismantling, transfer, repair or maintenance of any equipment, processes or machine, whether in relation to a scale up of operations or otherwise.

ii) Arbitration or mediation services (including involvement as an arbitrator or a mediator) in relation to any case or matter which does not relate to involve religion, race or community, a cause, or political end.

Foreigners performing Work Pass Exempt Activities can do so for the duration of their Social Visit Passes subject to a maximum of 60 days. Foreigners exempted from obtaining a Work Pass will need to e-notify MOM via our website before performing these activities.

1 a. Performing as an actor, singer, a dancer, or a musician or involvement as a key support staff, in an event supported by the Government or any statutory board constituted by or under any written law for a public purpose.

b. Performing as an actor, singer, a dancer, or a musician or involvement as a key support staff, in any event which is held at a performance venue to which the public or any class of the public has access whether gratuitously or otherwise (including any theatre or concert hall), but not at any bar, discotheque, lounge, night club, pub, hotel private club or restaurant.

2 Journalism activities (including media coverage for events or media tours) supported by the Government or any statutory board constituted by or under any written law for a public purpose.

3 Activities relating to any sports competitions, events or trainings (including involvement as a sportsman, a coach, an umpire, a referees or a key support staff) supported by the Government or any statutory board constituted by or under any written law for a public purpose, other than being engaged as a sportsman of any sports organisation in Singapore pursuant to a contract of service.

4 Participating in any exhibition or trade fair as an exhibitor or a trader.

5 Activities relating to any location filming or fashion show (including involvement as an actor, a model, a director, a member of a film crew or technical crew or a photographer).

6 Activities relating to the organisation or conduct of any seminar, conference workshop, gathering or talk which:

(i) does not relate, directly or indirectly, to any religious belief or to religion generally;

(ii) does not relate, directly or indirectly, to any race or community or to race generally; and

(iii) is not cause-related or directed towards a political end,

Including involvement as a speaker, moderator, facilitator or trainer.

7 Providing expertise or specialised skills: (i) In the commissioning or audit of new plant and equipment (including any audit to ensure regulatory compliance or compliance with one or more standards); or (ii) In the installation, dismantling, transfer, repair or maintenance of any equipment, processes or machine, whether in relation to a scale up of operations or otherwise except that, in relation to the installation, dismantling, repair or maintenance of any equipment or machine, the expertise or specialised skills shall be of a kind that is not available in Singapore or is to be provided by the authorised service personnel of the manufacturer or supplier of the equipment or machine (as the case may be).

8 Providing arbitration or mediation services (including involvement as an arbitrator or a mediator) in relation to any case or matter which- (i) does not relate, directly or indirectly, to any religious belief or to religion generally; (ii) does not relate, directly or indirectly, to any race or community or to race generally; and (iii) is not cause-related or directed towards a political end.

Work Pass Exempt Activities cover activities that are of short duration, sporadic in nature and with no employer-employee relationship. Some of them also require specialised skills or expertise that is generally not available in Singapore. You are allowed to work for the duration of your Social Visit Pass subject to a maximum of 60 days. Beyond that, you will need to obtain an Employment Pass, S Pass or Work Permit. You are required to notify the Ministry of Manpower (MOM) before engaging in these activities. You must also have a valid Social Visit Pass throughout your stay in Singapore. If you don't, you can be prosecuted under the Employment of Foreign Manpower Act.

Notifications can be made via the MOM website from 1 February 2008. E-notifications should be made after you have arrived in Singapore and prior to carrying out the exempted activities. The system will prompt you to confirm the details entered before submission. You will receive an acknowledgement immediately upon submission. The acknowledgement should be printed and produced to enforcement officers when requested. You will have to re-submit a new e-notification if you have submitted an erroneous e-notification. If you lost the acknowledgement letter you can print another acknowledgement letter using the ‘Re-print Function' of the e-notification service. You will be required to key in your travel document number and the travel document expiry date. You can amend/extend the period of activity via the ‘Extension Function' of the e-notification service. You total period of activity should be no longer than 60 days. You should also ensure that you have a valid Social Visit Pass to cover the period. After amending or extending the period, you should print the acknowledgement letter to be produced to enforcement officers when
